Agreement to Terms
By accessing or using the services of OpenGate Poinciana Tree Service, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. These terms apply to all visitors, users, and others who access or use our tree care services.
Services Provided
OpenGate Poinciana Tree Service provides professional tree care services including but not limited to tree removal, tree trimming and pruning, stump grinding and removal, emergency tree services, land and lot clearing, tree health and maintenance, arborist consulting, and shrub and hedge trimming. All services are provided in accordance with industry standards and local regulations.
We serve residential and commercial properties in Poinciana, Kissimmee, Orlando, St. Cloud, Celebration, Haines City, Davenport, Clermont, and surrounding areas in Central Florida. Our administrative office is located at 751 Cypress Pkwy, Kissimmee, FL 34759.
Estimates and Pricing
We provide free estimates for tree care services. All estimates are provided in good faith based on the information available at the time of inspection. Final pricing may vary if conditions differ from those observed during the initial estimate. We will notify you of any price changes before proceeding with additional work. All prices are subject to change without notice, but we will honor quoted prices for accepted estimates within 30 days of the quote date.
Payment Terms
Payment is due upon completion of services unless other arrangements have been made in advance. We accept cash, checks, and major credit cards. For large projects, we may require a deposit before starting work. Any outstanding balance must be paid within 30 days of invoice date. Late payments may be subject to a service charge of 1.5 percent per month or the maximum allowed by law, whichever is less.
Scheduling and Cancellations
We make every effort to arrive at scheduled times and complete work as agreed. Weather conditions, equipment issues, or other unforeseen circumstances may occasionally require rescheduling. We will notify you as soon as possible if we need to change your appointment. If you need to cancel or reschedule, please contact us at least 24 hours in advance. Cancellations made less than 24 hours before the scheduled service time may be subject to a cancellation fee.
Property Access and Preparation
You are responsible for ensuring that our crew has safe and clear access to the work area. This includes securing pets, moving vehicles that may obstruct access, and notifying us of any underground utilities, sprinkler systems, or other property features that could be affected by our work. We will take reasonable precautions to protect your property, but we are not responsible for damage to unmarked utilities, hidden obstacles, or items not disclosed to us prior to starting work.
Permits and Regulations
Property owners are responsible for obtaining any necessary permits for tree work unless we have specifically agreed in writing to obtain permits on your behalf. We will advise you if we believe permits may be required, but the ultimate responsibility for compliance with local ordinances rests with the property owner. We will not proceed with work that we know requires a permit until the proper permit has been obtained.
Insurance and Liability
OpenGate Poinciana Tree Service carries general liability insurance and workers compensation insurance. We will provide proof of insurance upon request. Our liability is limited to the amount of our insurance coverage. We are not responsible for pre-existing damage to trees or property, damage caused by natural events, or damage that occurs due to inaccurate information provided by the property owner.
Emergency Services
We provide emergency tree services for storm damage, fallen trees, and urgent hazardous situations. Emergency services may be subject to different pricing due to the urgent nature of the work and the need to respond outside of normal business hours. Emergency work is prioritized based on safety concerns and the order in which requests are received.
Warranty and Guarantees
We guarantee that all work will be performed in a professional and workmanlike manner. However, we cannot guarantee the health or survival of trees after pruning or other care, as many factors beyond our control affect tree health. Stump grinding is warranted against regrowth for 90 days. If regrowth occurs within 90 days, we will re-grind the stump at no additional charge.

We will make every reasonable effort to resolve any issues to your satisfaction. Any disputes that cannot be resolved through direct communication will be subject to mediation before pursuing legal action. These Terms of Service are governed by the laws of the State of Florida.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
